HOW CAN I AVOID JAIL TIME IN LAS VEGAS AFTER A CONVICTION?

In MANY cases, defendants can avoid going to jail in Las Vegas by pursuing “alternative sentencing,” such as 1) electronic monitoring, 2) house arrest, and/or 3) a rehabilitation program.

Electronic monitoring is where defendants wear a GPS-type ankle bracelet so law enforcement can keep track of their whereabouts. Nevada judges consider several factors when deciding whether to grant a defendant electronic surveillance, such as:

-whether the defendant has violent tendencies;
-the defendant's mental health; and
-whether the defendant has a history of substance abuse

Like it sounds, house arrest is when a Nevada court allows a defendant to forgo jail by staying confined to their home for a certain period of time under electronic monitoring. In many cases, a defendant under house arrest may be allowed to:

-go to work or school,
-go to doctors appointments or drug testing,
-go to counseling, community service, alcohol and drug counseling, tend to familial obligations, or
-go to court appearances, lawyer appointments, and any other activities approved by the court

Another alternative to jail are the various rehabilitation programs that many Nevada courts offer. The most common ones are DUI Court, Drug Court, and Veteran’s Court. These allow certain defendants to undergo intensive rehabilitation in lieu of some, or all of, their prison sentence. Rehab often involves electronic monitoring, frequent court appearances, biweekly counseling, and random drug testing. DUI Court participants may have to wear SCRAM bracelets that constantly measure their blood alcohol level.

Predictably, judges are more likely to grant alternative sentencing instead of jail to defendants who are non-violent, cooperative, and who do not pose a flight-risk. If people violate the terms of their alternative sentencing, such as by missing a court appearance, drinking, or going to a forbidden location, the judge may revoke the alternative sentence and impose prison.
