1. Can they be sued?
Determine whether you believe the hospital can be sued - either for is own negligence or for the medical malpractice of one of its employees

2. Find a Lawyer

3. Discuss your Case
Once you have short-listed a few attorneys that you believe might be a good fit for your case, call each attorney's office and discuss your case with them.
THEY MAY OR MAY NOT TAKE YOUR CASE.

4. Gather Information
Medical records, incident reports, photographs, and more. You and all those involved should write down every single detail you remember from that day of the incident. Remember that memory fades over time. Even though this exercise might bring up painful memories, it is important for building your case.

5. Damages
Try and figure out the damages you would like to request. Damages can include past and future medical expenses, past and future lost salary from missed time from work, as well as pain and suffering. Keep in mind some states have passed laws (i.e. MICRA) that limit the dollar amount of damages you receive for pain and suffering.

6. File your claim
Draft and file your complaint. Your complaint should include the negligent actions and resulting injuries, any claims you are asserting, and what your damages you are seeking for each claim. Your lawyer would be the one drafting this for you.
