Description from the creator

What can you do to prove your damages after an auto accident? In a word: “Documentation.”

In short, if you want to recover adequate compensation for injuries and damages you suffered in a personal injury lawsuit, you need to document your damages.

What kind of things should you document? Everything. But start with these:

1. The severity of the impact: right or wrong, insurance companies will base your compensation on the severity of the impact. We've heard countless times that the injuries our clients suffered could never have been caused in such a minor collision.

2. The injuries you suffer: seems obvious right. People think that their injuries should "speak for themselves." Not true. IF IT'S NOT IN THE MEDICAL RECORDS - YOUR INJURIES DON'T EXIST - from the insurance company's perspective at least. As such, its critical to report all your injuries to your doctor.

3. Same goes for your pain and suffering. Now is NOT the time to "tough it out." Tell the doctor everything you're dealing with. If you don't report the headaches and nausea for example that you suffered after the accident, you can argue with the insurance company until you're blue in the face. You will not be compensated for it.

4. Expenses such as prescriptions and mileage. If you buy Advil to manage your pain, keep the receipts. If you travel 20 miles to and from your doctor's office, document it in a mileage log. You can recover for these things.

Document everything you can to maximize your your personal injury lawsuit. If you would like additional information on how to document your claim, send us a message in the comments below or email us at [email protected]. If we can't help you, we'll find someone who can.
