How to form an LLC in South Dakota under the statute 47-34A-202 that allows a resident of the State to apply for a domestic Limited Liability Company for the purpose of transacting business within the State.

Steps
1 Choose Your Name. Choose the name of your LLC. Be sure to incorporate the industry you are in as well as the brand you will be building.
Check to see if the name you are choosing has not been registered by searching the South Dakota LLC Database.
2 Get South Dakota Articles of Organization. This will be your official form for applying to the Secretary of State. Completely fill in all the required fields either on your computer or printed out in black ink.
Pay $150 filing fee and make check payable to the 'Secretary of State'.
Mail Articles of Organization and filing fee to the following address: Secretary of State Office, 500 E Capitol Ave, Pierre, SD 57501.
3 Wait for Documents. You will have to wait for your LLC to process at the State for an estimated time of 5 to 7 business days. Your official LLC will be sent to the principal mailing address.
4 Apply for EIN Number. If you will be setting up a company bank account or have more than 1 Member in your LLC, then you will have to be recognized by the Internal Revenue Service (IRS) and will be required to have an EIN number (Tax ID Number).

Must be at least 18 years old.
Highly recommended to have an LLC Operating Agreement.
