How to Form an LLC in West Virginia under the statute 51B-1-101 for any resident to setup a domestic Limited Liability Company to operate a business within the State by applying online through an Articles of Organization.

Steps
1 Choose Your Name of Your LLC. - The first and most important step of creating your LLC is starting by choosing a name. It is recommended that the name you choose matches your industry and is brand-able.
Check to see if your name is already registered by checking the West Virginia Database.
2 Apply For LLC. - The State of West Virginia has moved their forming process online at the Secretary of State Webpage.
3 Follow the Steps. - The State will ask you a series of questions pertaining to the details of your company, if you do not know any of the answers you should seek the help of legal counsel.
At the end of the form you will have to pay a $100 filing fee.
4 Wait for the Mail. - When you have finished and submitted your form and filing fee you will have to wait an approximately 5 to 7 business days for your LLC to process and be sent back to your principal office address.
5 Apply for an EIN Number. - If you are planning to open a bank account with your LLC or you have more than 1 Member, you will need to have an EIN Number (Sometimes referred to as the Tax ID Number).
Apply for an EIN Number.

Must be at least 18 years of age.
Highly recommended to have an LLC operating agreement.
